These Terms Of Service govern the supply, hire, erection, inspection and collection of access equipment by NS EQUIPMENT LIMITED and the use of this website. By requesting a quotation, placing an order, accepting a delivery or using this website, you agree to these terms. Please read them carefully before you commit to a hire, because they set out the responsibilities of both the customer and the company.

1. Definitions

In these terms, the company, we, us and our mean NS EQUIPMENT LIMITED of Rm S239 2/F THE CAPITAL, 61-65 CHATHAM RD S, Tsim Sha Tsui, Hong Kong (HK). The customer, you and your mean the person or business that requests a quotation, places an order, accepts a delivery or enters a hire agreement with us. Equipment means all access equipment supplied by us, including scaffold towers, frames, braces, decks, toe boards, mobile access platforms, ladders, steps, fall protection gear and any associated component. Hire period means the period from delivery or erection until collection or dismantling is completed and the equipment is returned.

Site means the location at which the equipment is delivered, erected or used. Handover note means the document or message that records the equipment supplied, the references applied and the condition on handover. Load notice means the plate or label that states the safe working load of a structure. These definitions apply throughout these terms and in any related quotation or hire document.

2. Acceptance Of These Terms

These terms apply to every quotation, order and hire unless we agree otherwise in a signed written document. A quotation does not by itself create a contract. A contract is formed when you accept our quotation in writing, when you place an order that we confirm, or when you accept delivery of equipment, whichever happens first.

If you provide your own terms or purchase conditions, they do not apply unless we expressly accept them in writing. If any part of these terms is found to be unenforceable, the remaining parts continue to apply. Our failure to enforce a term on one occasion does not mean that we waive that term on a later occasion.

3. Quotations And Orders

We prepare quotations from the information you provide, which may include a description of the access point, photographs, drawings, working heights and site constraints. A quotation is valid for the period stated in it, or for fourteen days if no period is stated. Prices may change if the scope changes, if the site conditions differ materially from those described, or if the delivery or collection window falls outside our normal business hours.

An order is accepted only when we confirm it in writing and allocate the equipment. We may decline an order, or ask for further information, if we believe the requested system cannot be supplied or used safely at the site. Where an order requires equipment that is not immediately available, we will tell you the expected date and hold the order on that basis.

4. Use Of This Website

This website is provided for general information about our services. You may view, download and print pages for your own lawful business use. You must not copy, republish, sell or exploit the content for commercial purposes without our written permission, and you must not attempt to interfere with the operation of the site or gain unauthorised access to any part of it.

Content on this website is provided in good faith, but it is general in nature and does not replace a site specific survey. A description of a product or a service does not guarantee that the product or service is suitable for a particular job. Where a task involves work at height, the equipment must be selected and used by competent persons in line with applicable safety requirements.

5. Hire Terms And Duration

Equipment is hired for the period agreed in the order or in the applicable weekly or monthly plan. The hire period begins when the equipment is delivered or erected and ends when it is collected or dismantled and reconciled. A minimum hire period may apply, and the applicable minimum will be stated in the quotation. Hire charges apply for the whole of the agreed period, including days on which the equipment is not used.

If you need to extend a hire, tell us before the current period ends so that we can hold the equipment and keep the rate unchanged. If you keep equipment beyond the agreed period without telling us, we may charge the applicable rate for the extra time and, where it affects another booking, an additional charge for the disruption to the next customer.

6. Delivery And Collection

We deliver and collect inside our normal business hours unless we agree an out-of-hours window. You must provide safe access to the site for our vehicle and crew, a clear and level place to unload, and a person authorised to receive the equipment and sign the delivery note. If our crew cannot gain access at the agreed time, we may charge for the wasted visit and for any return journey needed.

Delivery dates and times are given in good faith but are estimates. Traffic, weather, building restrictions and events outside our control can affect them. We will keep you informed of any material delay. Collection follows the same principle: the equipment must be available, clear of obstructions and safe to handle when our crew arrives.

7. Erection And Dismantling

Where you order our site erection service, our crew will survey the location, lay sole boards, set base plates, build the system in controlled lifts and fit guard rails and toe boards as the work proceeds. The crew will tag the finished structure and provide a handover note. The scope of the erection service is limited to the equipment we supply and to the location described in the order.

Dismantling follows the build sequence in reverse and is carried out by our crew when the hire ends. You must tell us when the work has finished so that dismantling can be booked. If you dismantle or alter our equipment without our agreement, or if you move it to a different location, the structure may no longer match its tag and you become responsible for the safety of the altered arrangement.

8. Customer Duties On Site

You are responsible for the site while our equipment is in place. This includes providing a suitable surface, confirming the load capacity of the floor or ground, keeping the area around the equipment clear, and preventing unauthorised persons from climbing or interfering with it. You must also ensure that anyone who uses the equipment is competent for the task and has been briefed on the correct method of use.

You must tell us about any hazard that affects the equipment, such as a change of floor condition, new overhead services, exposed edges, strong wind exposure or a change to the building structure. You must not remove a safety tag, a load notice or a guard rail, and you must report any damage, incident or near miss to us without delay so that we can inspect the equipment and decide whether it can remain in service.

9. Inspection, Tags And Safety

Equipment is inspected before it leaves the yard and, for longer hires, at routine intervals during the hire period. Each structure carries a tag with its reference and a load notice stating the safe working load. Fall protection items carry serial numbers that are recorded against the hire ticket. An inspection confirms condition; it does not transfer responsibility for daily use, which remains with the customer.

Where an inspection identifies wear, damage or any other cause for concern, we may withdraw the equipment from service, replace a component or require the structure to be taken down until a repair is completed. We may suspend a hire immediately if we believe that continued use would create a risk to safety. We will explain the reason for any suspension and work with you to resolve it as quickly as possible.

10. Charges And Payment

Hire charges, erection charges, delivery and collection charges and any applicable minimum charges are set out in the quotation or the order confirmation. Charges are exclusive of any taxes or duties that apply, which will be added where required by law. Unless we agree credit terms in writing, charges are payable on or before delivery or as stated on the invoice.

If an invoice is not paid by its due date, we may charge interest on the outstanding amount at a reasonable rate and recover the costs of recovery. We may also suspend further deliveries or services and, where a hire is in progress, require the return of the equipment. Payment terms that we agree for one hire do not automatically apply to later hires.

11. Deposits And Security

We may ask for a deposit or another form of security before releasing equipment, particularly for high value items such as fall protection gear, specialist access systems or large platform units. The deposit is held against loss, damage, excessive cleaning and unpaid charges, and any balance is returned to you after the equipment has been inspected and reconciled.

Where a deposit is held, we will provide a record of the amount and the reason it is held. If a deduction is made, we will explain what it relates to and provide reasonable supporting detail. A deposit does not limit your liability for loss or damage that exceeds its value.

12. Loss, Damage And Cleaning

You are responsible for the equipment from delivery until collection, except where loss or damage is caused by our own crew acting within the scope of the erection service. If an item is lost, stolen, destroyed or damaged beyond normal wear, you must pay the replacement or repair cost stated in our current price list, plus any hire charges that run until the matter is settled.

Equipment should be returned in a reasonably clean condition. Heavy soiling, concrete, paint, resin, tar or hazardous residue may require specialist cleaning, and a cleaning charge may apply. You must not attempt to repair our equipment or modify it. If a fall protection item has been subjected to an impact load, you must report it immediately and remove it from use, because such an item must never return to service.

13. Restrictions On Use

Our equipment must be used only for its intended purpose and within the limits stated on its tag, load notice or instructions. You must not exceed the safe working load, dismantle or alter a structure, use equipment in a way that is unsafe, or use a fall protection item that has been involved in an impact. Equipment must not be sub-hired, lent, sold or moved to another site without our written agreement.

Where equipment is used near live electrical installations, over water, in confined spaces, in high wind or in any other unusual condition, the customer must ensure that the selection, the method of use and the protective measures are appropriate. If you are unsure whether a particular use is permitted, ask us before you proceed and we will confirm the position in writing.

14. Product Substitution And Availability

We aim to supply the exact items described in a quotation, but we may substitute an item with one of equal or better specification where this is necessary because of availability, maintenance or an improvement in design. A substitution will not reduce the safety of the system or increase the charges agreed for the hire.

Availability can be affected by demand, by inspection schedules and by events outside our control. If an item is not available for an agreed date, we will offer an alternative date, a suitable substitute or a full refund of any charge already paid for that item, and we will work with you to keep the project moving.

15. Limitation Of Liability

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot lawfully be excluded. Subject to that, our total liability arising from a hire or from the use of this website is limited to the charges paid for the equipment or service that gave rise to the claim.

We are not liable for indirect or consequential losses, including loss of profit, loss of business, loss of contract, loss of data or loss of goodwill, however they arise. We are not liable for loss or damage caused by the customer failing to follow these terms, by the customer altering equipment, by unsuitable site conditions, or by events outside our reasonable control.

16. Indemnity

You agree to indemnify and hold harmless NS EQUIPMENT LIMITED against claims, losses, damages and reasonable costs that arise from your use of our equipment, from your breach of these terms, from any alteration you make to a structure, or from any failure by you to provide a safe site or to brief the persons who use the equipment.

This indemnity does not apply to the extent that a claim results from our own negligence or from our failure to meet our obligations under these terms. Where a claim involves both parties, each party will be responsible for its own share of the loss in proportion to its responsibility.

17. Force Majeure

We are not liable for a delay or a failure to perform that is caused by an event outside our reasonable control. Such events include severe weather, typhoons, storms, flooding, fire, epidemic or pandemic restrictions, labour disputes, transport disruption, government action, failure of a utility or a supplier, and any other event that could not reasonably have been avoided.

If a force majeure event continues for a significant period, either party may end the affected hire by written notice. Where a hire ends in these circumstances, you pay for the period the equipment was with you and we refund any charge paid for a period that will not be served. Both parties will act reasonably to arrange the safe collection of equipment.

18. Suspension And Termination

We may suspend or terminate a hire if you fail to pay a due charge, if you breach these terms, if you use equipment unsafely or in a prohibited way, or if we reasonably believe that continued use would create a risk to people or property. Where possible, we will give notice and an opportunity to put the matter right before we take that step.

You may end a hire by giving us the notice stated in the order or, where no notice is stated, a reasonable period that allows us to arrange collection. Ending a hire early does not remove your liability for charges already incurred, for a stated minimum period or for loss and damage to the equipment.

19. Intellectual Property

All content on this website, including text, layout, graphics, the design of the scaffold motif and the arrangement of pages, is owned by NS EQUIPMENT LIMITED or is used with permission. These terms do not transfer any intellectual property right to you. You may not reproduce, adapt or redistribute our content without our written agreement.

Our name, our trading style and any associated marks remain our property. Any drawings, photographs or site records that we create in the course of a survey or an erection remain available to us for our records and for safety purposes, while any information you provide to us remains yours and is handled in line with our Privacy Policy.

20. Governing Law And Disputes

These terms and any dispute arising from them are governed by the laws of Hong Kong. The parties submit to the exclusive jurisdiction of the courts of Hong Kong. Before starting formal proceedings, the parties will try in good faith to resolve the matter through discussion and, where appropriate, through a structured negotiation or mediation.

If a dispute relates to the condition of equipment or to a charge, we will provide the relevant records, including handover notes, inspection outcomes and delivery records, to help the parties reach a fair conclusion. Nothing in this clause prevents either party from seeking urgent relief where that is necessary to protect safety or property.
